Attorney against new HOS rules

The Federal Motor Carrier Safety Administration's (FMCSA) new hours-of-service rule will only slightly reduce the number of deaths and injuries caused by truck-driver fatigue, according to trucking litigation attorney Michael Leizerman of E.J. Leizerman & Associates LLC.

Leizerman said the new rule, which will cut the number of off-duty hours from eight to 10 but allow drivers to spend an extra hour behind the wheel, is a step in the right direction, but falls short of the National Sleep Foundation's recommendations.

Leizerman is also concerned because the rule does not include the use of log books, whether they are manual or electronic.

"We don't discount the importance of increasing the number of off-duty hours," Leizerman said. "However, we would have liked equipment in the truck that would monitor the number of hours the truck driver actually works."
